Terms of Service
The rules for playing Emberfall, having an account, and playing on servers. Please read them; making an account means you agree to them.

1. Who we are
Emberfall is made and run by Thomas van Otterloo, the Netherlands ("we", "us"). Contact: [email protected]. These terms cover the game, the launcher, this website, your account, the account service, the relay, the server list and the servers we run (together, "Emberfall"). How we handle your data is in the Privacy Policy.
2. The game
Emberfall is free. We give you a personal, non-exclusive licence to download it with the launcher and play it. You may not sell it, charge for access to it, or pass off a changed copy of it as ours. Emberfall is in early development: expect bugs, changes and the occasional reset, and keep backups of worlds you care about.
3. Your account
- You must be at least 13 to make an account, and if you're under 16 you need a parent's or guardian's permission.
- One person per account. You're responsible for what's done with it, so keep your password to yourself. If you think someone else has got in, change your password or use "Sign out everywhere" on the account page.
- Use an email address you can read: it's the only way back in if you forget your password.
- Your account name must not pretend to be someone else, including us, and must not be offensive. We may rename or remove an account whose name breaks this.
- Don't make accounts in bulk or with automated tools.
4. How to behave
When you play with others, on our servers or anyone's, or use the server list, don't:
- harass, threaten or bully other players, or post hateful, sexual or violent material aimed at them;
- share anything illegal, or other people's personal information;
- spam, scam or advertise;
- cheat, use exploits or modified clients on servers whose rules forbid them (ours do), or wreck other people's things on servers whose rules forbid that;
- attack, overload, probe or try to break into Emberfall's services, or use them to attack anyone else.
5. What you make
What you build, write, paint and say in Emberfall is yours. Paintings you hang, signs, chat, server names and descriptions are shown to other players, so by putting them in the game you allow us and the server's other players to store and show them as part of playing. You're responsible for them: you need the right to use any picture you hang, and they must follow section 4. We, and server owners, may remove anything that doesn't.
6. Servers and the server list
- Most servers, including most in the server list, are run by other players. Their owners set their rules and decide what happens on them; we don't control them and aren't responsible for them or for what happens there.
- If you list a server, you're responsible for it and for what's on it. Its name and description must follow section 4. We may take any listing out of the list.
- On servers we run, we may reset worlds, wipe players, and kick or ban anyone who breaks these terms or the server's rules.
7. When we can act
If you break these terms, we may warn you, ban you from our servers, take your servers out of the list, or suspend or delete your account. We'll tell you why, unless the law or an ongoing abuse means we can't. If you think we've made a mistake, email us.
8. Ending it
You can delete your account at any time on the account page. We may change or stop Emberfall or any part of it, including the account service; if we're going to shut accounts down, we'll give notice in the launcher first.
9. No guarantees
Emberfall is provided free and "as is". We do our best to keep it working, but we don't promise it will always be available, free of bugs, or keep every world, player or account. As far as the law allows, we're not liable for lost progress, worlds or data, or for indirect losses. Nothing here limits our liability where the law doesn't allow it to be limited, such as for deliberate harm or gross negligence, and nothing takes away your rights as a consumer under the law of the country you live in.
10. Changes
We may change these terms. If a change matters, we'll say so in the launcher's news before it takes effect; carrying on playing after that means you accept it.
11. Law
These terms are governed by the law of the Netherlands. If you live in the EU, you also keep the protection of the mandatory consumer law of your own country, and can bring a claim there.
